Welcome to MeghaOS AI. These comprehensive Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and MeghaOS AI ("Company," "we," "us," or "our"), concerning your access to and use of the meghaos.in website, the MeghaOS operating system variants, the Megha AI Model APIs, and any other media form, channel, mobile website, or application related, linked, or otherwise connected thereto (collectively, the "Services").
By accessing, downloading, installing, or using our Services, you explicitly agree that you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
1. License and Permitted Usage
Subject to your strict compliance with these Terms, MeghaOS AI grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use our Services for their intended purposes.
- MeghaOS Home Edition: Licensed strictly for individual, personal, non-commercial use on a single device per license. Commercial deployment, redistribution, modification of the core kernel for redistribution, or hosting of the Home Edition as a service is explicitly prohibited.
- MeghaOS Enterprise Edition: Licensed on a per-seat, per-server, or site-wide basis as governed by a separate Enterprise Master Service Agreement (MSA). Enterprise customers are permitted to deploy the OS within their organizational network, utilize the offline AI capabilities, and leverage our MDM (Mobile Device Management) tools.
- MeghaOS Cybersecurity Edition: Authorized exclusively for legitimate, ethical security research, penetration testing, and vulnerability assessments on systems, networks, and applications that you own or have explicit, documented authorization to test. ZERO TOLERANCE: Any use of this edition to launch unauthorized attacks, deploy malware, or conduct illegal activities will result in immediate license revocation, permanent hardware ban, and reporting to relevant law enforcement agencies.
- Megha AI Model (0.6B LLM): Usage of our proprietary Agentic AI Model, whether via API or embedded locally, is subject to our Acceptable Use Policy. You may not use the AI to generate deepfakes, disseminate misinformation, automate cyberattacks, generate illegal content, or reverse-engineer the model weights. API usage is subject to the rate limits defined in your subscription tier.
2. User Accounts and Security
To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete account information and to maintain the security of your password and identification. You are entirely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.
3. Prohibited Activities
You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Prohibited activities include, but are not limited to:
- Systematically retrieving data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
- Tricking, defrauding, or misleading us and other users, especially in any attempt to learn sensitive account information such as user passwords.
- Circumventing, disabling, or otherwise interfering with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the Content contained therein.
- Disparaging, tarnishing, or otherwise harming, in our opinion, us and/or the Services.
- Using any information obtained from the Services in order to harass, abuse, or harm another person.
- Deciphering, decompiling, disassembling, or reverse engineering any of the software comprising or in any way making up a part of the Services, including the AI model architecture.
4. Intellectual Property Rights
Unless otherwise indicated, the Services are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Services (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions.
5. User Generated Content
The Services may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Services, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions"). You retain full ownership of your Contributions. However, by transmitting Contributions, you grant us a non-exclusive, worldwide, royalty-free license to host, store, and display such Contributions for the purpose of operating the Services.
6. Subscription, Billing, and Refunds
If you purchase a premium Service (such as Enterprise Support or API quotas), you agree to provide current, complete, and accurate purchase and account information. You agree to promptly update account and payment information. We bill you through an online billing account for purchases. We reserve the right to refuse any order placed through the Services. Refund requests for software licenses and API credits are evaluated on a case-by-case basis in accordance with our Refund Policy; however, generally, digital OS licenses and consumed API credits are non-refundable.
7. Disclaimers and Warranties
THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THE SERVICES.
8. Limitation of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
9. Indemnification
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your Contributions; (2) use of the Services; (3) breach of these Terms of Service; (4) any breach of your representations and warranties set forth in these Terms of Service; (5) your violation of the rights of a third party, including but not limited to intellectual property rights.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and defined following the laws of the State of Delaware, United States. MeghaOS AI and yourself irrevocably consent that the courts of Delaware shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms. Any legal action of whatever nature brought by either you or us shall be commenced or prosecuted in the state and federal courts located in Delaware, and the parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens.
11. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Services. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services. We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors.
